The role of the Executor
A Will is a legally enforceable declaration of how a person wants their assets distributed after death.
A Will addresses the desires of the individual and can include, but is not limited to, naming guardians for minor children, specifying funeral preferences, and revoking any previous Will.
Although most states only require witnesses to document the signing of a Will to make it legally valid, if the will is contested, the witnesses must be able to certify that the Will is valid. To avoid the witness certification of a contested Will, a Will Notarization is often issued as part of the execution of the Will.
Trust Establishment
A Living Trust is a legal arrangement created while there person is alive to hold, manage, and eventually distribute his\her assets.
The core idea is simple: The property is placed into a trust, to control it during his/her lifetime, and the chosen trustee distributes it to the beneficiaries after he/she passes away — without probate.
A living trust because it offers:
Avoidance of probate — assets pass privately and efficiently.
Control during life — you can use, spend, or live in the assets you place in the trust.
Privacy — unlike wills, trust distributions aren’t public record.
Protection for beneficiaries — especially minors or individuals with special needs.
Smooth management if incapacitated — your successor trustee can step in without court intervention.
A Trust, and many of its sub-elements, must be Notarized. Some documents require State registration to be valid.
